This following document sets forth the Privacy Policy for the Power & Posture website http://www.powerandposture.com.au.

Power & Posture is committed to providing you with the best possible customer service experience. Power & Posture is bound by the Privacy Act 1988 (Cth), which sets out a number of principles concerning the privacy of individuals.

Collection of your personal information

There are many aspects of the site which can be viewed without providing personal information, however, for access to future Power & Posture customer support features you are required to submit personally identifiable information. This may include but not limited to a unique username and password, or provide sensitive information in the recovery of your lost password.

Sharing of your personal information

We may occasionally hire other companies to provide services on our behalf, including but not limited to handling customer support enquiries, marketing or processing enrolments. Those companies will be permitted to obtain only the personal information they need to deliver the service. Power & Posture takes reasonable steps to ensure that these organisations are bound by confidentiality and privacy obligations in relation to the protection of your personal information.

Use of your personal information

For each visitor to reach the site, we expressively collect the following non-personally identifiable information, including but not limited to browser type, version and language, operating system, pages viewed while browsing the Site, page access times and referring website address. This collected information is used solely internally for the purpose of gauging visitor traffic, trends and delivering personalised content to you while you are at this Site.

From time to time, we may use customer information for new, unanticipated uses not previously disclosed in our privacy notice. If our information practices change at some time in the future we will use for these new purposes only, data collected from the time of the policy change forward will adhere to our updated practices.

Changes to this Privacy Policy

Power & Posture reserves the right to make amendments to this Privacy Policy at any time. If you have objections to the Privacy Policy, you should not access or use the Site.

Accessing your personal information

You have a right to access your personal information, subject to exceptions allowed by law. If you would like to do so, please let us know. You may be required to put your request in writing for security reasons. Power & Posture reserves the right to charge a fee for searching for, and providing access to, your information on a per request basis.

Terms & Conditions

 *Agreement to terms and conditions.

IMPORTANT: By buying our products and/or signing up for any of our memberships and/or booking a class, you acknowledge that you have read and agree to Power & Posture's™ terms and conditions including withdrawals and refund policies.  

All registrations are final – if the program is moved online due to government mandated regulations, you will not be entitled to a transfer or refund.

1. Class General Terms

​ 1.1  Power & Posture reserves the right to refuse entry and registrations based on a number of factors including but not limited to: credit history with the company, health conditions, the lack of commitment to and/or inability to commit to the membership duration.

1.2  Power & Posture reserves the right to suspend or prohibit future attendance of any participant in its programs on grounds including, but not limited to, offensive behaviour and conduct, harassment, sudden and/or undisclosed injuries and/or health problems.

1.3  Every possible effort is made to deliver classes and services on time as advertised. However, the schedule is subject to change or cancellation without notice. Power & Posture is not liable to refund, transfer or offer compensation of any kind for classes that are late, changed or cancelled for any reason.

1.4  No late entry is permitted and leaving class early is strongly discouraged.

1.5  Every student must register upon arrival and in the case of the pass holders, their pass should be presented to the desk prior the class.

1.6  Power & Posture is not responsible for the safekeeping of your belongings.

1.7  Please arrive at least ten minutes before class as there is no late admittance. The studio is open 15 minutes before class start times.

1.8  Personal belongings are to be placed in the shelves provided.  

1.9  Students are to wipe mats used for their practice and the surrounding space before leaving the studio.

1.10  All purchases are final. Power & Posture offers an intangible and irrevocable service therefore does not offer refunds on services or products for change of mind, user error, injury, illness, change of address or any other reason.

1.11  Fees may increase from time to time to reflect increases in costs.

1.12  Assigning CS certified coaches to each group in a cycle can be done at the centre's discretion without prior notice.

2. Clearance to exercise.

2.1  All participants are strongly advised to seek medical clearance prior to participating in Power & Postureʼs programs. Power & Posture will not be liable for any unknown or undisclosed medical condition upon commencement and/or during the time of any Power & Posture program.

2.2  Each participant is required to complete a pre-exercise questionnaire addressing all relevant health information. The pre-exercise questionnaire merely serves as additional background information to assist in the delivery of Power & Postureʼs services.

2.3  Participants who have any contra-indications to exercise will be required to obtain and submit a written medical clearance from a general medical practitioner prior to the commencement of the first session of the program.

3. Matters Pertaining to injury

3.1  As a participant in Power & Postures classes, all students recognise and acknowledge that there are certain risks for physical injury and agree to assume the full risk of physical injuries.

3.2  Power & Postureʼs instructors guide participants the best they can following the information on medical conditions and injuries given, and are not responsible for the injuries attained in any of the classes within the program.

3.3  In attending classes at Power & Posture, you agree that neither you, your heirs, assigns or legal representatives will sue or make any other claims of any kind whatsoever against Power & Posture or its members for any personal injury, property damage/loss, or wrongful death, whether caused by negligence or otherwise.

4. Memberships / Programs

4.1.  Membership fees will be charged to your credit card or bank account once per week via a third party biller. Passes or packages paid in full prior to program start date may be paid by cash if members choose to do so.

4.2.  It is your responsibility to ensure there are sufficient funds available to cover the weekly auto-debit. Should a payment be declined for any reason, Power & Posture reserves the right to process payment at anytime to settle any debt owed. If an auto-debit is declined due to insufficient funds, the transaction will fail which requires additional administration and yields additional bank costs. Power & Posture will not absorb these costs and applies a $9.90 fee for these failed transactions. This fee is debited 7 days after the failed payment.

4.3.  Power & Posture is not responsible for additional bank fees that you may incur from your bank. Bank fees are under the terms and conditions of contractual agreements that lie between you and your bank.

4.4.  The terms and conditions of our third party biller form a binding component of your membership agreement.

4.5.  An initial commitment of at least 8 weeks is required. Members will not be able to pause or cancel their membership during this commitment period. Pauses, cancellations and suspensions will be processed following a 14-day notice after the 8 week commitment period is honoured.

4.6.  Memberships run on a weekly debit. Passes (8 and 16) and packages (e.g: personal training packages) are paid in advance.

5. Cancellation Policies

5.1 Launch, Bodyweight B, Killer B programs and Personal Training packages.

    5.1.1  STRICTLY NO REFUNDS or transfers or credits for face to face and / or online programs as spaces in the program are limited. Your space in the program cannot be fulfilled by someone else for the duration of the program.

    5.1.2 REFUNDS for Personal Training packages may be processed up to 7 days prior to package start date. STRICTLY NO REFUNDS or transfers or credits for prepaid packages upon commencement.

6. Withdrawal and Cancellation Policy for the CS Coaching Certification

  • Power & Posture’s training is highly regarded and places in the program are limited. Accordingly it is necessary for us to have a clear and upfront policy in place that encourages prospective students to consider the course carefully and apply with a full sense of commitment and responsibility.

  • If you are enrolling into the Controlled Strength Teacher Training program:

  • Withdrawal from the course must be made in writing and sent through via email.

  • Withdrawal from the course at least 6 weeks prior to the commencement of the program will incur an administrative fee of $200.00.

  • Withdrawal from the course less than 6 weeks prior to the commencement of the program will incur an administrative fee of $350.00.

  • Participants withdrawing less than 1 week prior to the commencement of the course or once the course has commenced are not entitled to any refund of course fees.

7. Withdrawal and Cancellation Policy for the CS Mentorship Program

  • Power & Posture’s training is highly regarded and places in the program are limited. Accordingly it is necessary for us to have a clear and upfront policy in place that encourages prospective students to consider the course carefully and apply with a full sense of commitment and responsibility.

  • If you are enrolling into the Controlled Strength Mentorship program:

  • Withdrawal from the course must be made in writing and sent through via email.

  • Withdrawal from the course at least 6 weeks’ prior to the commencement of the program will incur an administrative fee of $500.00.

  • Withdrawal from the course less than 6 weeks prior to the commencement of the program will incur an administrative fee of $750.00.

  • Participants withdrawing less than 1 week prior to the commencement of the course or once the course has commenced are not entitled to any refund of course fees.

WARNING UNDER THE AUSTRALIAN CONSUMER LAW AND FAIR TRADING ACT 2012

Under the Australian Consumer Law (Victoria), several statutory guarantees apply to the supply of certain goods and services. These guarantees mean that the supplier named on this form is required to ensure that the recreational services it supplies to you –

  • are rendered with due care and skill; and

  • are reasonably fit for any purpose which you, either expressly or by implication, make known to the supplier; and

  • might reasonably be expected to achieve any result you have made known to the supplier.

Under section 22 of the Australian Consumer Law and Fair Trading Act 2012, the supplier is entitled to ask you to agree that these statutory guarantees do not apply to you. By participating in Power & Posture's classes, you will be agreeing that your rights to sue the supplier under the Australian Consumer Law and Fair Trading Act 2012 if you are killed or injured because the services provided were not in accordance with these guarantees, are excluded, restricted or modified in the way set out in this form.

NOTE: The change to your rights, as set out in this form, does not apply if your death or injury is due to gross negligence on the supplier's part. Gross negligence, in relation to an act or omission, means doing the act or omitting to do an act with reckless disregard, with or without consciousness, for the consequences of the act or omission. See regulation 5 of the Australian Consumer Law and Fair Trading Regulations 2012 and section 22(3)(b) of the Australian Consumer Law and Fair Trading Act 2012.
